Ministry of Commerce released Announcement No.57, 2004 on Nov 14, 2004, deciding to impose anti-dumping duties on ethanolamine originated from Japan, the US, Iran, Malaysia, Taiwan Region and Mexico (hereinafter referred to as “investigated commodities”).

In December 2006, Oriental Union Chemical Corporation and NIPPON SHOKUBAI CO.,LTD put forward applications to Ministry of Commerce，applying for midterm review on dumping and dumping margin of ethanolamine. On Feb 1, 2007, Ministry of Commerce released announcement, deciding to carry out review on anti-dumping measures of ethanolamine originated from Oriental Union Chemical Corporation and NIPPON SHOKUBAI CO.,LTD. The investigation includes normal price, export price and dumping margin. The tariff codes of the investigated commodity are 29221100 and 29221200. Mono-ethanolamine and 2-ethanolamine under above tariff codes are not included in the investigated commodities.

In accordance with investigation, Ministry of Commerce proposed to change the anti-dumping duties. In accordance with regulations of Anti-dumping Regulations of the People’s Republic of China and Provisional Measures on Midterm Review of Dumping and Dumping Margin of Ministry of Commerce, released issues are now announced as follows:

In line with investigation, Ministry of Commerce finally verdicts the dumping margin of Oriental Union Chemical Corporation is 5.3%, and NIPPON SHOKUBAI CO.,LTD. 7.3%.

In accordance with Anti-dumping Regulations of the People’s Republic of China, Tariff Committee of the State Council decides to adjust the anti-dumping duty rate on ethanolamine originated from Oriental Union Chemical Corporation to 5/3% and adjust the anti-dumping duty rate on ethanolamine originated from NIPPON SHOKUBAI CO.,LTD. to 7.3% .

The formula for calculation of anti-dumping duty: Anti-dumping duty=after tax price*anti-dumping duty rate.

In accordance with Article 53 of Anti-dumping Regulations of the People’s Republic of China, interested parties may apply for administrative review in line with laws or start a legal proceeding to the People’s Court.

The Announcement shall take effect as from Feb 1, 2008.
