In accordance with Article 48 of Anti-dumping Regulations of People’s Republic of China, the timelimit of anti-dumping imposition shall not be longer than 5 years and the the timelimit of anti-dumping duty imposition coulde be properly prolonged if the termination of anti-dumping duty imposition might cause continuance or reoccurance of dumping and injuries.
As from the promulgation of this Announcement, the domestic industries, nature person or legal person of domestic industries or related organizations could apply for an expiry review in written forms when 60 days ahead of the termination of the related anti-dumping measures. The application shall include sufficient evidence that the termination of anti-dumping duty imposition might cause continuance or reoccurance of dumping and injuries.
If the domestic industries, nature person or legal person of domestic industries or related organizations failed to raise a written petition for an expiry review in accordance with this Announcement, or the Ministry of Commerce have no initiative expiry review before the the termination of anti-dumping measures, the original anti-dumping measures shall be teminated as from the expiration date.
